TRIAL TRANSCRIPT EXCERPTS

BRIEF BACKGROUND
The government's case against Leonard Peltier primarily revolves around information from five locations.  The first being testimony concerning and evidence collected from in and around the Oglala residence of Harry and Cecelia Jumping Bull, called the Jumping Bull Compound, the second,  from a station wagon which exploded near Wichita Kansas, the third,  from a stop made in Oregon of a station wagon and a motorhome owned by Marlon Brando,  from Chief Small Boy's Camp in Alberta, Canada, and lastly, from a subsequent raid on Al Running's and Leonard Crow Dog's residence in Grass Mountain.  A series of evidentiary hearings in January, preceding this trial from which transcript excerpts are posted below, precluded any documents which would have shown discrepancies and inconsistencies in the evidence presented.  This fact led to a split decision as the case crumbled against Leonard Peltier for murder atainst either agent.  the government was forced to concede there existed no evidence on this charge and fell back upon "aiding and abetting" {a ten year felony}..SO WHY IS LEONARD STILL IN PRISON?

 BE IT REMEMBERED that heretofore, on Monday, the 14th day of March, 1977, the above-entitled cause came on regularly for trial in said court at the hour of 9:30 o'clock, a.m., before the Honorable PAUL BENSON, one of the Judges of said court, at Fargo, North Dakota, and a jury duly empaneled.
