The United States legal system is based on precedent. When any case appears in court, rulings are based on specific laws and any previous cases which are similar. In our country, precedent IS law. Holly Zane is right. Once anything is built on the Huron Cemetary, that becomes a precedent for FURTHER future plans. This situation is similar to the old story of the camel wanting into the tent. If we let the camel stick his nose in, soon we're living with the entire camel.
If the Oklahoma Wendat are allowed to build a 'temporary' casino on the cemetary, it's usage classification has been changed. Any legal protection it might once have had will be lost. There will be nothing to stop them from upgrading the building to a permanent structure. Opening the Woodlands casino will be entirely beside the point.
Washington, where I live, is well endowed with 'temporary' structures that were never torn down. If the Oklahoma tribe is so short of funds, what's to stop them from using or leasing a downtown casino for some other business? Nothing. Having acquired the property, I don't see them letting go of it again. If they had any respect for those buried there, they never would have begun this in the first place. It wouldn't be the first construction site where bodies were disinterred 'by accident'. Once the bodies are disturbed, and the damage is done, there's no going back. Once the site is used for comercial enterprise of any sort, there's no going back.
